SuperTrees provides top quality trees and plants to our buyers. Problems which may arise need to be submitted in writing within seven days and will be handled on an individual basis. Terms of a Wholesale account with SuperTrees: All sales will be pre-paid until credit is approved. All orders are subject to stock on hand, crop conditions, acts of God and availability. Prices are subject to change at sole discretion of Seller. Seller accepts no liability for any financial loses due to unavailability or physical condition of stock. Upon credit approval payment is due 30 days from date of invoice, unless otherwise specified on the face of invoice. Applicant hereby agrees to pay service charge of 1.5% per month on all over-due accounts both before and after judgment, and continuing each month until paid. Seller reserves the right to refuse shipment to customers whose account balances are beyond terms. In the event that it becomes necessary for SuperTrees Incorporated to collect payment, applicant agrees that such suit may be brought in Clackamas County,Oregon, at seller's option, and seller shall be entitled to court costs, attorney's fees, and collection fees. The undersigned purchaser agrees that invoices and statements are conclusive and accurate in all respects unless undersigned purchaser notifies Seller in writing within seven (7) days of receipt of the invoice or statement in question. Prices are FOB Seller unless otherwise stated. We are not liable for material damaged while in transit, unloading, or after delivery. Short counts must be noted on Bill of Lading with driver's signature before truck departs your location. All claims for unsatisfactory material must be in writing and faxed to Seller within 48 hours of delivery.
